Terms of Service

1. Agreement to Terms

By accessing and using Trend Axis Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to abide by the above, please do not use this service.

2. Service Description

Trend Axis Studio is a Software-as-a-Service (SaaS) platform that enables users to generate AI-powered images using the OpenAI DALL-E 3 API. Users provide textual prompts, and the Service generates corresponding images for purchase and download.

3. Eligibility

  • You must be at least 18 years of age to use this Service.
  • You are responsible for ensuring your use of the Service complies with all applicable laws and regulations in your jurisdiction.
  • You agree not to use the Service for illegal, harmful, or unethical purposes.

4. User Accounts and Credentials

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are fully responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Content Moderation and Prohibited Uses

To ensure responsible AI usage, all prompts are screened through OpenAI's content moderation system before image generation. Prompts that violate OpenAI's usage policies will be rejected, and generation will not proceed.

You agree not to use the Service to:

  • Generate images of hate, violence, illegal activities, or harm to individuals or groups
  • Create images depicting graphic sexual content, non-consensual intimate imagery, or child exploitation
  • Violate intellectual property, privacy, or publicity rights of third parties
  • Engage in harassment, abuse, or defamation
  • Circumvent content policies through obfuscation or prompt injection

Violations may result in immediate account suspension and permanent ban from the Service.

6. AI-Generated Content and Copyright

Important Legal Notice: Images generated by DALL-E 3 are not protected by copyright under U.S. law and most jurisdictions. This is because they are created by artificial intelligence without human authorship.

Your Rights:

  • You own the right to use and download purchased images.
  • You may use images for personal, commercial, and derivative purposes.
  • You may reproduce, modify, and distribute purchased images.

Your Responsibilities:

  • You are responsible for ensuring your prompts do not attempt to replicate copyrighted works, trademarks, or third-party intellectual property.
  • You may not use images in ways that violate laws or third-party rights (e.g., impersonation, defamation, harassment).
  • You acknowledge that Trend Axis Studio is not responsible for copyright disputes arising from the content of your prompts.

7. Pricing and Payment

  • Pricing tiers are clearly displayed during checkout: Starter ($10), Creator ($15), Professional ($20), Premium ($25).
  • Prices are in USD and do not include applicable sales tax, which will be added at checkout if required.
  • All purchases are processed through Stripe and subject to Stripe's terms and conditions.
  • Payment must be completed before image generation begins.
  • We reserve the right to modify prices with 14 days' notice.

8. Refunds and Satisfaction Guarantee

When Refunds Are Granted:

  1. Image Quality Mismatch: If the generated image does not match your prompt due to DALL-E's interpretation or revision of your input.
  2. Technical Failure: If the Service fails to generate or deliver an image due to a technical error on our end.
  3. Payment Processing Error: If you were charged multiple times due to our system error.

Refund Process:

  • Refund requests must be submitted within 30 days of purchase.
  • Our admin team will compare your original prompt with the DALL-E revised prompt and the generated image.
  • A one-click refund will be processed via Stripe, and the image download will be revoked.
  • Refunds are issued within 5–10 business days to your original payment method.

When Refunds Are NOT Granted:

  • Buyer's remorse or change of mind (without quality/technical issues)
  • Requests submitted more than 30 days after purchase
  • Prompts that deliberately violated content policies but passed moderation
  • Issues caused by user error (e.g., unclear prompts, misunderstanding DALL-E's capabilities)

9. Image Downloads and Expiration

  • Generated images are available for download via a 24-hour pre-signed URL.
  • Download links expire automatically after 24 hours for security and storage efficiency.
  • We recommend downloading your images immediately after purchase.
  • If your download link expires, contact support to request a replacement link.

10. Rate Limiting and Fair Use

  • Users may attempt checkout a maximum of 5 times per hour.
  • Exceeding this limit will result in a temporary restriction on that session.
  • Repeated violations may result in account suspension.

11. Data and Privacy

We collect and process personal data including email, order history, prompts, and generated images. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

12. Service Availability and Limitations

  • The Service is provided on an "as-is" basis without guaranteed uptime.
  • We are not responsible for service interruptions due to OpenAI API outages, cloud infrastructure maintenance, or force majeure events.
  • We will use commercially reasonable efforts to maintain service availability.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUALITY OR ACCURACY OF GENERATED IMAGES.

We do not guarantee that images will meet your specific expectations or business needs.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TREND AXIS STUDIO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC TRANSACTION IN QUESTION.

15. Indemnification

You agree to indemnify and hold Trend Axis Studio, its owners, operators, and agents harmless from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, your content, or your infringement of third-party rights.

16. Modifications to Terms

We may modify these Terms at any time. Changes will be effective upon posting to the Service. Continued use of the Service after modifications constitutes acceptance of the updated Terms.

17. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without notice or liability, if you violate these Terms, engage in fraud or illegal activity, or abuse the Service or other users.

18. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any legal action must be brought exclusively in the federal or state courts located in California.

19. Dispute Resolution and Arbitration

Any disputes arising from this Service shall be resolved through binding arbitration administered by JAMS, rather than in court. Each party waives the right to jury trial and class action participation.

Exceptions: Claims for injunctive relief or intellectual property infringement may be brought in court.
